Expert Testimony

What is a 730?

You always have the right to your own expert to testify on your behalf. Upon the proper Motion to the court, the court may determine that an expert is needed for the courts assistance. This can reduce costs, if both parties agree to rely on the court's expert to determine, let's say, the value of the community business, then you would only have to pay for one expert instead of each party having their own expert and thereby doubling expert costs. This expert appointed by the court to assist the court is appointed under Evidence Code 730, hence the name. Be prepared to contribute some or all of the cost of a 730 expert.

Forensic Accountant

A Forensic is an expert who is experienced in testifying in court as the courts expert under >Evidence Code Section 730. A forensic accountant may testify after review of all relevant documents, as to the value of a business, a retirement or tracing separate property contributions to a community asset.

Vocational Exam

A vocational examiner determines, through researching the job market and interviewing the party, what that party may be able to earn in the market. Since child and spousal support orders now may be based upon a party's earning ability, the role of a vocational evaluator is invaluable.

Child Custody Evaluator

The courts frequently appoint a child custody evaluator to assist the court in making a child custody and visitation schedule and recommendations. The evaluator may interview parties, interview collateral references, do a "home study" or conduct psychological exams. The child custody evaluation is then submitted to the court in writing before the hearing and sent also to the attorneys for review. Please note that this document is kept confidential from the parties in most instances.
