Uncontested Matters Hey! Those are my priceless Limited-edition Star Trek collector plates! Believe it or not, divorce need not be ludicrously expensive, nor difficult. If you and your spouse are in agreement on the division of marital assets, you may be able to obtain an uncontested divorce. This is by far the cheapest solution, which also minimalizes emotional war and tear. It takes a little compromise of course-you'll have to skip the shouting match about who gets to keep the Ikea bookcases or the Star Trek collector plates, but ultimately, you'll come out ahead. If both parties agree on EVERYTHING, the matter may go forward as an Uncontested Matter. The problem is that it's never that easy. If you try to use one attorney for both parties and suddenly it goes astray, both of you are without counsel, since the attorney is aware of privileged information and can no longer represent either one of you fairly. It is best for one party to retain counsel and the other party to hire counsel on an as needed basis to review proposals and the final Judgment before it is filed with the court. Always expect, the unexpected and you won't be disappointed. You think you'll save money with a paralegal? Think again. Those ads which pronounce "Divorce $300" are a trap. Yes, they'll file your dissolution action for you, but that's all. That doesn't mean a complete case, just the filing of the Petition. Most attorneys only bill one (1) hour for that service at their hourly rate, usually $250 an hour....LESS than the paralegal. You hear so many stories about people going to court to enter the final Judgment which was prepared by a paralegal and the papers get rejected and the court will not let you get divorced. Only an attorney that practices primarily family law will know the up to date court rules and the local local court rules for each Department, since they are there everyday. |
