Civil Subpena Duces Tecum

Civil Subpena Duces Tecum A party may serve a Civil Subpena Duces Tecum on a third party to obtain records. Those records must be produced on the date of the hearing by the third party. Common Subpenas include those to acquire bank statements, payroll records and tax returns directly from the source. Notice must be sent to you before the Subpena is served on the third party in case you need to file an opposition requesting a Protective Order if the records are privileged or irrelevant.
