Dissolution/Divorce

Mandatory Waiting Period for Dissolutions

Just in case the parties reconcile, the Court's require 6 months and 1 day to pass before the marital status may be terminated. The clock begins to tick when the Respondent has been served with the Petition for Dissolution. When am I officially Divorced? Although the waiting period is 6 months, you are not actually divorced until the Judgment of Dissolution has been filed with the Court. Believe it or not, this can take years if there is a dispute and the case goes to trial! Even after trial, the divorce is not final until one of the parties or their counsel type up the Court's orders and enter the Judgment. Also some Courts are so backlogged that the Court does not enter it for months.

Divorce. It's a tough word. Some know it merely as a song by Tammy Wynette. Others have heard terrifying testimonials by friends and/or relatives who have gone through it. But as George Carlin pointed out, divorce is not the end - it's two people beginning a new life. That's why you want to choose an attorney who will help you make smart choices and protect your interests, so that the next phase of your life really will be a new beginning.
